The Muslim Marriages and Divorces (Registration) Act, 1974 mentions about registrations of Muslim marriage and divorce. As per section 6 of the Act, A registrar may register a divorce under Muslim Law on the application being made to him for registration.
Step 1 | The person who is giving divorce needs to sign and put his or her thumb impression in the Registrar Book (Balal Book) of marriage registrar.
Step 2 | At least 2 male witnesses will sign in relevant notices and Registrar Book (Balal Book) of marriage registrar.
Step 3| The marriage registrar (Kazi) must issue a Divorce Certificate after passing of 3 months from the date of serving the Divorce Notice.
Time to complete the one-sided divorce process:
The one-sided divorce or divorce by notice can be completed within 90 days from the date of serving the notice to the Mayor of City Corporation or Chairman of Union Parishad.
